These Terms of Service ("Terms") govern your use of the hosting, domain, SSL and related services ("Services") provided by FinjanHost ("we", "us", "our"). By ordering or using our Services, you agree to these Terms.
1. Your Account
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You must provide accurate, current information and keep it up to date. You must be legally able to enter into this agreement.
2. Acceptable Use
Your use of the Services must comply with our Acceptable Use Policy. You may not use the Services for unlawful content, spam, malware distribution, intellectual-property infringement, or any activity that harms our network or other customers.
3. Payment & Renewals
Services are billed in advance for the term you select (monthly or annual, and multi-year where offered).
Promotional pricing applies to your first term. Renewal is at the standard rate shown for each product at the time of purchase.
A free domain included with a yearly or 2-year plan is free for its first year only. After that it renews at the standard price for that domain.
Services renew automatically unless cancelled before the renewal date. You are responsible for cancelling services you no longer want.
Domain registrations and SSL certificates are non-refundable once issued.
4. Refunds
Eligible hosting plans carry a 30-day money-back guarantee as described in our Refund Policy. Setup fees, domains and certificates are excluded. If your plan came with a free domain, its regular price is deducted from the refund.
5. Service Availability & Backups
We work hard to keep your services online and take regular backups, but you remain responsible for maintaining your own independent backups of your data. We are not liable for data loss resulting from your actions or from factors outside our reasonable control.
6. Suspension & Termination
We may suspend or terminate Services for non-payment, violation of these Terms or the Acceptable Use Policy, or where required by law. Where practical, we will give you notice and an opportunity to resolve the issue.
7. Limitation of Liability
To the extent permitted by law, our total liability for any claim relating to the Services is limited to the amount you paid us for the affected service in the three months preceding the claim. We are not liable for indirect or consequential losses.
8. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through your client area or by email. Continued use of the Services after changes take effect constitutes acceptance.
